TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS

1.1. These online store terms (hereinafter – the Terms) are a legally binding document setting out the rights and obligations of the Buyer and the Seller (hereinafter – "Company code: 307144426"), and the conditions for the purchase and sale of goods.

1.2. The Seller reserves the right to change, amend or supplement these Terms at any time.

1.3. Before ordering goods, the Buyer must read the Terms in force. The purchase and sale agreement is deemed concluded when the Buyer places an order in the online store having read these Terms.

2. CONCLUSION OF THE PURCHASE AND SALE AGREEMENT

2.1. The purchase and sale agreement between the Buyer and the Seller is concluded when the Buyer creates and submits an order for goods in the online store.

2.2. The Seller has the right to refuse to fulfil an order if, due to unforeseen circumstances, the ordered item is not available. In such a case the Seller undertakes to inform the Buyer and, where necessary, to offer an equivalent item or to refund the amount paid.

3. PURCHASE TERMS AND PAYMENT

3.1. The Buyer may pay for goods using the online banking services of Swedbank, SEB, Luminor, Citadele and Šiaulių bankas. Payments can be made in euros. Payments are processed using the MakeCommerce.lt or Montonio payment platform.

3.2. All prices are stated in euros (€) and include VAT. A delivery charge may be added to the price of the goods where applicable.

3.3. The Buyer undertakes to provide accurate details necessary for fulfilling the order.

4. DELIVERY AND RISK

4.1. Goods are delivered to the Buyer at the address specified by them, using third-party courier services.

4.2. Delivery times are indicative and depend on third-party delivery service providers. The Seller is not liable for delays in delivery arising from unforeseen circumstances (for example, courier delays, customs issues, weather conditions).

4.3. The Buyer must state the delivery address accurately and ensure that the goods will be accepted at that address.

5. RETURNS AND EXCHANGES

5.1. Goods of satisfactory quality may be returned within 14 calendar days of the day they are received, provided they are unused, undamaged, in their original and undamaged packaging, and have not lost their saleable appearance.

5.2. When returning goods, the following conditions must be met:

  • The item must be in its original, intact and undamaged packaging (this point does not apply where an item of unsatisfactory quality is being returned).
  • The item must be unused and undamaged.
  • The item must not have lost its saleable appearance (labels, protective films and so on must be undamaged).

5.3. Goods are returned at the Buyer's expense, except where the item is of unsatisfactory quality or is being returned because of an error by the Seller.

5.4. Goods whose colour, size or other characteristics did not meet the Buyer's expectations for subjective reasons (for example, the colour appearing different on a monitor) are not exchanged or returned.

5.5. Goods of unsatisfactory quality may be exchanged or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania. The manufacturer's warranty applies according to the terms and duration set by the manufacturer of the particular watch.

6. WARRANTIES

6.1. The watches sold by the Seller are covered by the manufacturer's warranty, which covers manufacturing defects.

6.2. The warranty period and conditions are stated with each product description or supplied together with the watch's warranty card.

7. DISCOUNTS AND LOYALTY PROGRAMMES

7.1. The Seller may offer special offers, discount codes or loyalty programmes, the conditions of which may vary depending on the promotion.

7.2. Discounts cannot be combined with other promotions or discounts unless stated otherwise. Discount codes may have an expiry date or other usage restrictions.

8. RIGHTS AND OBLIGATIONS OF THE BUYER

8.1. The Buyer has the right to purchase goods from the Seller in accordance with these terms and the legislation of the Republic of Lithuania.

8.2. The Buyer must pay for the goods purchased and accept them in accordance with the stated conditions.

8.3. By using the online store, the Buyer confirms that they agree to these terms and conditions of sale and must comply with them.

9. RIGHTS AND OBLIGATIONS OF THE SELLER

9.1. The Seller undertakes to enable the Buyer to use the services of the online store in accordance with the conditions set out in these terms.

9.2. The Seller reserves the right to suspend the operation of the Online Store because of technical problems or other unforeseen circumstances.

9.3. The Seller undertakes to deliver the goods to the Buyer in accordance with the order, unless this becomes impossible due to unforeseen circumstances (disruption at suppliers or couriers). In such a case the Buyer has the right to choose between an exchange of goods or a refund.

10. FORCE MAJEURE

10.1. The Seller is released from liability for failure to perform its obligations where this is caused by unforeseen circumstances beyond the Seller's control, including but not limited to supply chain disruption, disruption of courier services, natural forces, pandemics, or other force majeure circumstances.

11. FINAL PROVISIONS

11.1. These Terms have been drawn up in accordance with the legislation of the Republic of Lithuania.

11.2. These Terms, and the relationship between the Parties in respect of these Terms, are governed by and construed in accordance with the laws of the Republic of Lithuania.

11.3. All disagreements arising from the performance of these Terms shall be resolved by negotiation. If agreement cannot be reached, disputes shall be resolved in the manner prescribed by the laws of the Republic of Lithuania.
